Early termination fee on yearly contract monthly billing

Commercial Account “Early termination Fee”

• All account under a Plan base will be charge per call and credit all funds. (depends on the time of the month you will have a credit or charge)

• Shape up.inc will cancel your account if customer is frequently late and late charges access to the account are or not return.

• Shape up reserves the right to charge late fee, percentage fee or administration fee.
• Shape up reserves the right to sue, sell the debt, or lien any property. (shapeup.inc does not and will not owner any Nonalien contract or lien release unless otherwise payees in full before or after.
• Shape up reserves the right to turn any account to pay per service in advance.
• Charge will be access for each property under a contract.
• A 3.5% increase will be access to the contract
• All contracts are autorenewal unless customer 2 month before informed us

• Late charges of 35.00 will be access every 30 days until it reach 800.00 over 800 is a 3,5% late charge.

  Contract Requirement for Services

  Shape Up Landscaping, Inc. provides services only under a contractual agreement. This agreement may be either a signed written contract or a verbal contract with a clearly defined payment structure. No services will be rendered without one of these agreements in place.

  Visit Charges

  Every scheduled visit is a billable visit. This means that each time our crew is dispatched—even if work cannot be completed due to weather or other uncontrollable circumstances—the visit will still be charged according to the contract terms.

  Early Termination Fees

  Either party may cancel this contract at any time with 60 days’ written notice. If the client cancels without providing the required notice, a cancellation fee of $1,500 to $3,000 will apply, depending on the circumstances. An additional administrative fee of $2,500 will be charged if the cancellation fee is not paid promptly.

  Legal Reference to Florida Law

  Under Florida law, this Agreement is enforceable whether made verbally or in writing, as long as there is a clear mutual understanding and a defined payment structure. By agreeing to these terms and initiating payment, both parties acknowledge that these conditions are legally binding under Florida contract law. This ensures that any verbal modifications or additional payment agreements made in good faith are also upheld.

Adverse weather and hurricane policy 

These policies are created in case we are not able to service your household during these adverse weather or hurricane conditions
1. Hurricanes/ tropical storms/ winds over 35 mph. If these conditions are foretold in the weather, please know that we will not service your homes at these times. No credits will be issued, but we can add a service call to your dry season. The dry season starts on October 1st.

2. Lightning and hazardous conditions. If these conditions occur, we will not service your home at this time and will service your home the next day. (As long as it’s not a hurricane)
   3. Shapeup Inc. reserves the right to service your home if it’s unsafe for crew and equipment.
   4. Shapeup. inc reserves the right to service your home if it sees it unfit due to debris and it becomes a cleanup.
   5. Due to certain conditions gas shortages may occur please know we are going to service your home once we can acquire the gas.

All Customer that we go to weekly and only charge once time a month is contract These are based on a yearly landscaping plan/contract From June 1st to Sept 30 weekly mowing from Oct 1st to May 31 biweekly or as needed not exceeding 30 to 32 cuts a year any additional cuts are at price quoted.

If customer cancel shape up reserved the right to charge any card, bank account or form of payment to recuperate  any service not payeed

Cutting

Cuts are done at 3.5 for Bahia grass unless asked for the levels and Florita, Bermuda and Zoysia are 4.5 and 5.0 depending on customer
Any over 6 inches of grass are additional, if overgrown and we cannot see your sprinklers we are not liable.
