Early termination fee on yearly contract monthly billing

 
Commercial Account “Early termination Fee”
Either party may cancel this contract at any time with 30 days’ written notice. In the event that the Client terminates, this Agreement within (3) years from the date of approval for reasons other than “substantial documented non-performance” or this Agreement is terminated by Shape up. Inc prior to the expiration of the initial term due to an Event of Default or non-payment for services rendered we will suffer a substantial injury for which it is impracticable orextremely difficult to fix actual damages. In an effort to liquidate in advance the sum that should represent such damages, you agree to pay us an “Early Cancellation Fee” of the greater
of: (a) $500 multiplied by the remaining months of the Agreement or (b) $500, whichever is greater.
 
Residential customer “Early Termination Fee”

IF THE CUSTOMER DECIDES TO CANCEL DURING THE DRY SEASON ACCOUNT WILL BE TURNED TO PER VISIT AT PRICE PRESET BY CONTRACT AT A PER VISIT PRICE FROM THE FIRST DAY, WE STARTED TO GO WEEKLY OR TURN TO WEEKLY. WE WILL ADD ALL DOES VISIT AND APPLY YOUR PAYMENT THE DIFFERENCE WILL BE OWN UPON RECEIPT OF THE BILL PLUS A 500 EARLY TERMINATION FEE. IF YOU HAVE ANY ISSUE, PLEASE TELL US EARLY WE DUE HAVE INSURANCE AND OR PAY FOR WHAT EVER DAMAGE WE CAUSE TO PERSONAL PROPERTY IF BROUGHT IN WITH IN 10 DAYS OF THE ISSUE.

Payment must be Done upon receipt of the final bill, after 10 pass due you will be charging a 150,00-pass due and send to a collection company.

Adverse weather and hurricane policy 

These policies are created in case we are not able to service your household during these adverse weather or hurricane conditions
1. Hurricanes/ tropical storms/ winds over 35 mph. If these conditions are foretold in the weather, please know that we will not service your homes at these times. There will be no credits issued but we can add a service call to your dry season. Dry season starts on October 1st.

2. Lightning and hazardous conditions. If these conditions occur, we will not service your home at this time and we will service your home on the next day. (As long as it’s not a hurricane)
3. Shapeup inc reserves the right to service your home if it’s unsafe for crew and equipment.
4. Shapeup.inc reserves the right to service your home if it sees it unfit due to debris and it becomes a cleanup.
5. Due to certain conditions gas shortages may occur please know we are going to service your home once we are able to acquire the gas.


All Customer that we go weekly and only charge one time a month are contract These are the: This is based on a yearly landscaping plan/contract From May 1st to Sept 30 weekly mowing from Oct 1st to April 30 biweekly or as need it.

We included

1)mowing rain season 4 time a month or as need it 05/01 to 09/30 and dry season biweekly 10/01 to 04/30

2)trimming

3)blowing

4)removing debris under 1 cub ft

5) 5 mulched of bag are free

6) edging.

7) weeding is done as needed. (if you have. Massive amount of weed we will pull some and the rest will be roundup or pull in next visit. Whatever we pull out we will put chemical to kill the roots system
